什么是适当的法律程序？(due process of law?)
正当法律程序是一个法律概念，在世界许多国家都可以找到。在全球范围内，人们普遍认为，人们有权获得法律规定的公平待遇，法律体系必须保护与该体系接触的个人的权利。在一些国家，正当程序被明确定义并受到法律保护，而在另一些国家，它可能没有被具体阐明或提到名字，但它仍然在法律体系中发挥着作用。
正当程序有两个关键方面。第一个是法律的程序性正当程序，它涉及到法律的执行方式。法律必须平等地适用于所有人，一致地加强，法律的执行必须遵循既定的准则。这包括刑事诉讼等活动，这些活动遵循既定的准则。如果不向人们提供程序上的正当程序，可能会导致质疑或误审，因为人们可能会辩称他们没有得到法律上的公平对待。
实质性的正当法律程序涉及一项法律首先是否合法的问题。许多国家对政府不能干预的某些活动有法律保护。如果可以证明某项活动属于这些保护范围，那么限制该活动的法律就可能被认为是违反了实质性的正当程序。
实质性的正当程序可能会变得非常复杂，因为法律当局往往没有方便说明的法律。因此，他们在评估一个案件时必须看法律的精神，以确定该案件是否违反法律。例如，如果法律禁止种族歧视，它可能不会具体说 "禁止亚洲人拥有财产是不合法的"，但如果法律只是这样做，就可以根据它明显违反了反歧视法的精神这一论点而被推翻。
