什么是美国宪法有保障吗？(guaranteed by the u.s. constitution?)
美国宪法保障美国公民的一些权利和自由。
- 刑事案件中陪审团审判的权利得到保障。（第3条第2款）
- 每个国家的公民都有权享有其他国家公民的特权和豁免。（第4条第2款）
- 人身保护令的要求不得中止，入侵或叛乱期间除外。（第1条第9节）
- 国会和各州都不能通过公民权利法案
- 国会和各州都不能通过事后法律
- 国家不得通过任何损害合同义务的法律。（第1条第10款）
- 不允许进行宗教测试或取得担任联邦职务的资格。（第6条）
- 不允许贵族头衔。（第1条第9款）
人权法案
1787年制宪会议的制定者们认为，这八项权利对于保护美国公民是必要的。然而，许多不在场的个人认为，如果不增加一项权利法案，就无法批准《宪法》。
事实上，约翰·亚当斯（John Adams）和托马斯·杰斐逊（Thomas Jefferson）都认为不将最终写入宪法前十条修正案的权利包括在内是不合理的。正如杰斐逊在写给“宪法之父”詹姆斯·麦迪逊（James Madison）的信中所说，“人权法案是人民有权反对地球上每一个政府的东西，无论是普通政府还是特殊政府，任何政府都不应拒绝或依靠推论。”
为什么不包括言论自由？
许多宪法制定者之所以没有将言论和宗教自由等权利纳入宪法正文，是因为他们认为，将这些权利列出来实际上会限制自由。换言之，人们普遍认为，列举保障公民的具体权利，意味着这些权利是由政府授予的，而不是所有个人从出生起就应该享有的自然权利。此外，通过具体命名权利，这反过来意味着那些没有具体命名的权利将得不到保护。亚历山大·汉密尔顿（Alexander Hamilton）等其他人认为，应该在州一级而不是联邦一级保护权利。
然而，麦迪逊看到了增加《权利法案》的重要性，并编写了最终将增加的修正案，以确保各州批准。
